Clients demand value now more than ever.  Based in Kansas City, Nicol Mediation offers nationwide service and experience, but at Midwest rates.  We streamline the resolution process from the beginning, including an online booking system, individual pre-mediation conferences to “set the table” prior to the actual mediation, and efficient use of time and technology throughout.  Below are the general guidelines to mediation.

 

What is Mediation?


Mediation is a process in which a trained neutral third party facilitates alternative dispute resolution (ADR) communications between parties to promote settlement and to assist them in reaching a voluntary agreement about their dispute. 

A mediator is the individual who conducts the mediation.  A mediator may not impose his or her own judgment on the issues for that of the parties.

Attendance is Essential

The mediated dispute may either be pending in a court or may be a potential dispute yet to be filed in court. Attendance at the mediation conference is voluntary by the parties, except where ordered by a court or governed by a statute or contract.  But attendance at the mediation by the parties or their representatives with full authority to settle is essential.

In-Person or Virtually

The mediation session may be held in-person or virtually via secure online video conferencing.  If in-person, the mediation session is held at a neutral third-party site or at any party's facility.

The Mediator is Not Legal Counsel

All parties recognize that during the mediation session, and at all other points in the proceeding, the mediator is not acting as legal counsel for or as a representative of any of the parties engaged in the mediation; the mediator has no duty to assert, analyze, inform or protect any legal right or obligation; the mediator has no duty to make an independent expert analysis or raise issues the parties do not raise; and the mediator cannot guarantee the mediation will result in a settlement.
